Welcome to authz.ca! These Terms of Service (“Terms”) govern your access to and use of the website located at https://authz.ca (the “Website”), operated by Banana Bytes Publishing Inc. (“we,” “us,” or “our”). We are based in New Westminster, British Columbia, Canada.

The Website is hosted using Netlify, a third-party service provider. While we make reasonable efforts to keep the Website available, we cannot guarantee uninterrupted or error-free service and are not responsible for the actions of third-party providers.

These Terms apply when you access or use the Website. When you submit information through our Contact Page, the notice beside the submission button asks you to acknowledge these Terms. If you do not accept them, do not submit the form or otherwise use a feature that requires agreement.

By submitting information through our Contact Page, you agree that:

• You are providing your email address and any other information voluntarily.
• We may use your email address to respond to your inquiry and for limited communication as described in our Privacy Policy.
• You have read and understand our Privacy Policy.
• You will not submit any spam, malicious content, or content which violates Section 2.2.
• You acknowledge that by submitting the form, you are agreeing to these Terms.

3. User-Generated Content

• Ownership: You retain ownership of any User-Generated Content you submit to the Website.
• License to Us: By submitting User-Generated Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User-Generated Content solely for the purpose of receiving, processing, and responding to your inquiry on the Website, and for our internal administrative purposes.
• Scope: At present, User-Generated Content is limited primarily to submissions via the Contact Page. Future interactive features, if introduced, will also be governed by these Terms.
• Responsibility: You are solely responsible for your User-Generated Content and the consequences of posting or publishing it.
• Content Moderation: We reserve the right (but have no obligation) to monitor, review, edit, remove, or refuse to post any User-Generated Content for any reason, including if we believe it violates these Terms or is otherwise objectionable.
• Representations and Warranties: You represent and warrant that: (i) you own or have the necessary licenses, rights, consents, and permissions to use and authorize us to use all rights in and to any User-Generated Content to enable its inclusion and use in the manner contemplated by the Website and these Terms; and (ii) your User-Generated Content does not violate any law or infringe the rights of any third party.

The Website and its original content, features, and functionality (excluding User-Generated Content) are and will remain the property of Banana Bytes Publishing Inc., its contributors, or its licensors, as identified. The Website is protected by copyright, trademark, and other applicable laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent. 5. Third-Party Services & Links

The Website uses Third-Party Services such as Netlify for hosting and contact-form processing and Google for contact correspondence. We select and oversee providers in light of the service and information involved, but we do not control their independent systems or guarantee uninterrupted availability. Links to unrelated third-party sites are provided for reference and do not imply endorsement. Nothing in this section excludes a responsibility that applicable law places on us for personal information under our control or for our own selection, instructions, or conduct.

THE WEBSITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE WEBSITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING THE QUALITY, ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS, OR RELIABILITY OF ANY CONTENT OBTAINED THROUGH THE WEBSITE.

8. Indemnification

This section applies only to losses reasonably arising from your material breach of these Terms, unlawful User-Generated Content, or violation of another person’s rights, and only to the extent permitted by applicable law.

You agree to defend, indemnify and hold harmless Banana Bytes Publishing Inc. and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Website, or b) a breach of these Terms, or c) your User-Generated Content, or d) your violation of any law or the rights of a third party.

9. Termination

We may terminate or suspend your access to the Website immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Website will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without giving effect to choice-of-law rules that would select another jurisdiction’s law. This provision does not exclude consumer, privacy, or other rights that cannot lawfully be waived, and it does not determine the law governing a claim brought by a person who is not bound by these Terms.

11. Dispute Resolution

Informal Resolution: Before filing a formal legal claim concerning these Terms, you and Banana Bytes Publishing Inc. will make a reasonable effort to resolve the dispute informally through the Contact Page. This requirement does not prevent either party from seeking urgent relief, meeting a limitation period, preserving evidence, reporting a matter to a regulator, or using a court or tribunal process that cannot lawfully be restricted.

Subject to any mandatory law and a court’s authority to hear or transfer a proceeding, you and Banana Bytes Publishing Inc. submit to the courts of British Columbia for disputes arising from these Terms. These Terms do not require arbitration.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect by posting the updated Terms on this page. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Website after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Website.
